Terms and Conditions

The following general terms and conditions apply, however regional circumstances and regulations, contractual obligations to suppliers, and matters relating to location, service type and supply logistics may cause these to be varied slightly for specific services, or specific destinations. These amendments and alterations should be read in conjunction with the Terms And Conditions shown below.

1. Payment
A deposit of 25% is required on booking for any service or making reservations. The balance of 75% must be paid prior to commencement of any excursion/itinerary/flight/trip. A payment of 100% is required in case the client(s) cannot make a deposit earlier due to late bookings or specified terms of offer. Credit cards can be used in major cities and towns ONLY but please do not rely on them as a method of payment because they are generally not widely accepted. You should be aware that to purchase products or services on a credit card a fee of 5%-10% usually applies.

2. Prices
Please verify all included and excluded items or expenses indicated in the itineraries: entrance fees to parks, meals, accommodation types, service charges, government taxes. All prices exclude the cost of passport, visa, insurance, health document gratuities, laundry, drinks, and other personal items. All prices are subject to change without advance notice based on increased rates and/or fluctuations in foreign currency and oil prices. This especially applies to AIR and transportation fares.

3. Cancellation and No Show Fee
Due to release periods, limited and high demand for services and hotel rooms we would like you to note that cancellation fee will be levied once booking has been confirmed. The cancellation charges are subject and guided by supplier contracts first, and in some instances suppliers will not give a refund but a credit note to be utilized later. For our managed services our cancellation charges are as follows - Within 7 to 28 days prior to safari - 25%. Within 6 days and/ or no show - 100% They take effect from the day we receive the cancellation in writing.

4. Accommodation
Prices are based on double occupancy. On single bookings there is a supplement for nights spent. Single rooms cannot always be guaranteed due to limited space. Should an accommodation fall to provide single occupancy despite payment of supplement, the applicable amount is refundable. Accommodations are listed in preferred sequence. They range from modern hotels in deluxe resort complexes, hotels, chalets to permanent camps on safari circuits. Most have private bathroom and/or swimming pools, restaurant and bar facilities.

5. Alterations to Itinerary
If the client(s) alters any part of the itinerary (before or during the expedition), the previous costing and packaged inclusions become invalid and therefore do not bind Oakland Tours & Safaris in any way until a new itinerary is issued subject to terms and conditions. The company reserves the right to alter arrangements of the route or cancel the operation of a scheduled tour should unavoidable or conditions beyond our control like unfavorable climate, government regulation, civil unrest, political unrest or natural disaster necessitate. It also reserves the right to decline to accept or retain any person as a member of any tour at any time, in which event an equitable amount of money will be refunded. The sequence and accommodation of all itineraries is normally adhered to but we reserve the right to make alterations due to bad weather, roadworks, high season congestion or any other cause. Any delays due to breakdowns/mechanical failures of vehicles on safari will not be the liability of the company.

6. Liability
(a) Oakland Tours and its agents act only as agents of the client in all matters relating to accommodation, sightseeing, excursions, tours and all forms of transport. The company cannot accept any responsibility for default whether negligent or otherwise on part of any services or accommodations with which the booking is made or which clients arrange themselves, nor is it liable for clients' additional expenses occasioned by their delay, alteration of travel services, sickness, injuries or as a result of weather, civil disturbances or whatsoever interferes with, interrupting, altering or adding to the cost of services, excursions or tours applied for and booked.

(b) The Company's liability to passengers carried in vehicles as used for transfers, excursions and tours is governed by the laws of Kenya and all claims are subject only to the courts of Kenya.

(c) The company reserves the right to employ subcontractors and in the event of such exercise of such right the terms of clause (a) relating to the Company's liability shall apply.

(d) Whilst every care is taken, the Company cannot be responsible for lose or damage to personal property and it is advisable to arrange relevant insurance. All these liabilities are governed by the Kenya Association of Tours Operators Code of Conduct and by the Tourism Regulatory Authority (TRA) of which we are licensed tour operators.

7. Valuables
Please keep this with you at all times. Safety deposit facilities are available at most accommodations. Campers are especially expected to take care of their valuables at all times.

8. Caution
All expeditions involve an element of personal risk and can be of hazardous nature. By acknowledging or signing or accepting to the expeditions every participant must accept this risk and we are therefore not liable for any loss, damage, injury, delay or inconvenience caused to you or your property/personal items as a result, directly or indirectly howsoever caused. All participants are advised to take travel, medical and personal insurance to cover personal accidents and medical expenses and this can be arranged on request at an extra cost to the participant.
