Tapestry of Africa Tours and Safaris: Booking Terms and Conditions
The following represents the Service Contract (“Agreement”) between Tapestry of Africa Tours and Safaris (managed by Jensen Adventures, LLC) (“Company”), and the Client named within. The Services contracted shall be the travel, tour, and/or lodging services described herein. Please read this Agreement carefully and raise any questions or concerns that you have with the Company before agreeing to the contract. This Agreement will begin upon its execution.
1. SERVICES
The Company offers tours in the following countries:
Kenya
Tanzania
Uganda
Botswana
Zimbabwe
Republic of South Africa
Services provided may include:
-All lodging contained in the written proposal and quote. Additional lodging before or after the itinerary can be arranged for an extra cost.
-Meals as specified in the Client’s proposal and quote.
-Park and reserve fees unless stated in the “Optional, Not Included” section of the proposal.
-Private Guide and Vehicle (shared/group tours include shared vehicles and drivers for game drives and transportation).
-Drinking water in rooms and safari vehicles (restaurant drinks, including water, are excluded unless specified).
-Domestic air transfers, as outlined in the itinerary.
-Other local transportation and transfers unless mentioned otherwise in the quote or proposal.
-Additional services agreed upon after the initial consultation will be included in the individualized proposal and quote.
2. BOOKING, PAYMENT, AND CANCELLATION
Booking and confirmation constitute agreement to these Terms and Conditions and require the safari deposit to be paid for all travelers in the party.
-A 25% deposit of the total safari cost is due at the time of booking to secure the itinerary and accommodations.
-Another 25% is due 90 days prior to arrival.
-The final balance is due 45 days prior to arrival.
Late Bookings:
-For tours booked less than 90 days prior to arrival, a 50% payment is required at the time of booking.
-For tours booked less than 45 days prior to arrival, the full balance is due immediately.
Pricing and Availability Disclaimer:
All quotes are based on availability at the time of booking. Once the deposit is received, reservations will be secured. If any accommodation is unavailable, comparable replacement options will be provided.
Important Note on Pricing:
The total price quoted is based on the number of travelers in the party and the age category of each traveler (Adult, Minor ages 2–11, Minor ages 12–17). If the number of travelers or their age categories change from what is listed in the attached quote—at any time before the commencement of the safari—the total safari price will be adjusted accordingly. This includes cancellations, additions, or substitutions within the traveling party, as shared costs (such as private vehicles, guides, and accommodations) are divided based on group size.
Cancellation Policy:
-90 Days or More Before Arrival: Clients receive a 100% refund of all payments made.
-Between 90 and 45 Days Before Arrival: All fees paid are non-refundable. However, the Company will make every effort to work with our safari lodge partners to recover any portion possible. Any refund is not guaranteed.
-Less than 45 Days Before Arrival: All fees paid are non-refundable, and the Client forfeits 100% of payments made.
Please note: that from time to time, certain lodges, camps, or third-party services included in your itinerary may have non-refundable deposit policies. Upon cancellation, the traveler will be informed which deposits are non-refundable. Refunds for cancellations, even those that fall within the cancellation windows outlined below, will only apply to services for which a refund is available. It is the responsibility of the traveler or client to request this information in advance if they require clarity before making a deposit.
The following is a list of families/companies of lodges and services that have known nonrefundable deposits, but is not limited to:

-Serena lodges and camps
-Elewana lodges and camps
-Internal safari flights included in the itinerary
-Gorilla and Chimpanzee Permits
Payment Methods:
The Company accepts payment via credit card, Google Pay, bank transfer, or other mutually agreeable methods. No additional fees are charged for credit card payments.
3. WARRANTIES
The Company represents and warrants that all Services performed under this Agreement will be executed professionally and in accordance with applicable commercial standards.
The Company also warrants it is legally allowed to conduct Services in the jurisdiction where the Client’s tour occurs.
Additional warranties provided by the Company will be detailed in the Client’s individualized proposal and quote.
4. CONFIDENTIALITY
The Company protects the privacy and confidentiality of its communications with Clients.
The Company will not divulge personal or proprietary information to third parties without written permission unless required by law.
5. ASSUMPTION OF RISK
The Client acknowledges and understands that participation in safari travel involves inherent risks, many of which are beyond the control of Tapestry of Africa Tours and Safaris (“the Company”). These risks include, but are not limited to:
Wildlife and Environmental Risks:
-Safari tours take place in natural habitats where wild animals roam freely. While every effort is made to ensure safety, wildlife encounters are unpredictable and may result in injury or death.
-The presence of insects, snakes, and other potentially dangerous creatures is a natural part of the safari experience.
-Adverse Weather and Acts of Nature:
-Travel in Africa is subject to unpredictable and extreme weather conditions, including heavy rains, flooding, high winds, lightning, dust storms, and extreme heat.
-Such conditions may result in road closures, delays, or the inability to access certain destinations.
Natural Disasters & Acts of God:
The Client acknowledges that natural events beyond the control of Tapestry of Africa Tours and Safaris may occur at any time and may impact travel plans, routes, or the ability to complete the itinerary as scheduled. These include, but are not limited to:
-Flooding that renders roads impassable
-Earthquakes, landslides, or other geological events
-Severe storms or extreme climate conditions
-Epidemics, pandemics, or other public health emergencies
-Government-imposed travel restrictions or advisories due to natural disasters
Tapestry of Africa Tours and Safaris will make every reasonable effort to adjust itineraries and assist Clients in finding alternative arrangements when such events occur. However, the Client understands and accepts that:
-The Company cannot predict, control, or alter these events.
-The Company is not responsible for additional expenses incurred due to forced itinerary changes, including accommodations, transportation, or rescheduling costs.
-Any changes made to the itinerary while in progress due to natural disasters or Acts of God will be at the Client’s expense. The Company will make every effort to recover payments or secure partial refunds where possible, but reimbursement cannot be guaranteed.
Health and Medical Risks:
Travel in remote areas may expose the Client to infectious and non-infectious diseases. The Client is responsible for obtaining recommended vaccinations, medications, and taking necessary precautions.
Access to medical facilities and emergency services may be limited.
Civil or Political Unrest:
Changes in political or civil stability may affect travel plans. While the Company monitors such situations, it cannot guarantee safety or uninterrupted itineraries in the event of unrest.
Transportation and Infrastructure Risks:
Safari travel often involves long journeys on rough, unpaved roads. Conditions may be bumpy and unpredictable.
Mechanical failures, road closures, or accidents can occur despite adherence to safety protocols.
Loss or Damage to Personal Property:
The Client is responsible for securing their personal belongings. The Company is not liable for lost, stolen, or damaged luggage, passports, electronics, or valuables.
By choosing to participate in a safari, the Client voluntarily assumes all risks, including but not limited to:
-Personal Injury or Death: From wildlife encounters, physical activities, accidents, or medical emergencies in remote areas.
-Emotional or Psychological Trauma: Resulting from unexpected incidents or experiences.
-Property Damage or Injury to Others: The Client assumes responsibility for any damage they may cause to property or harm to others.
-The Client agrees that Tapestry of Africa Tours and Safaris is not liable for any losses or disruptions caused by these inherent risks. The Client also acknowledges they have read and understand the General Safety and Security Guidelines, available on the Company’s website, and agrees to follow all safety instructions provided by guides and tour staff.
6. LODGES AND CAMPS
Tapestry of Africa Tours and Safaris makes no guarantees regarding the satisfaction of chosen lodges or camps.
The Company is not the owner or operator of recommended accommodations.
The Client confirms they have conducted due diligence on selected lodges or camps through research or other means.
The Company is not liable for missing amenities or misrepresented details on lodge or camp websites.
7. LIMITATION OF LIABILITY
The Company makes no guarantees beyond those expressly provided in this Agreement.
The Company’s liability is limited to the amount paid by the Client for services rendered through the date of cancellation or termination.
The Client is solely responsible for decisions and actions related to their safari or personal matters.
8. TRAVEL INSURANCE
The Company maintains customary insurance for negligence.
Clients are strongly encouraged to purchase travel insurance covering:
Emergency medical care
Evacuation
Trip cancellation
Other travel-related coverage
9. JURISDICTION AND DISPUTE RESOLUTION
This Agreement is governed by Kenyan law.
Disputes will be resolved through confidential, binding arbitration in accordance with Kenyan regulations.
10. MISCELLANEOUS
Contractors/Agents:
The Company may use contractors or agents to fulfill obligations under this Agreement.
Marketing Opt-Out:
Clients may opt out of photo or testimonial use by providing written notice within 48 hours of signing.
Severability:
If any provision is invalid, the remaining provisions remain enforceable.
I have read the above Terms of Service for Traveler services and have had the opportunity to ask questions for clarification or greater detail. I hereby understand and agree to the above conditions of service.
