PAYMENT TERMS

To confirm your reservation a 30% down payment is required, unless otherwise agreed in writing with your consultant.

Balance Payment

Unless otherwise agreed in writing, the outstanding balance is payable upon arrival and may be settled by:

• Cash in USD
• Cash in Kenyan Shillings (KES) at the prevailing exchange rate applied by Axis Africa Expedition & Safaris Ltd
• Credit/Debit Card, subject to a 4.1% processing surcharge

Online card payments are subject to a 4.1% processing surcharge and must be completed at least two (2) working days before safari commencement to allow sufficient time for payment confirmation.

For bank transfers, all sender, receiver, correspondent, and intermediary bank charges shall be borne by the client. The full invoiced amount must be received by Axis Africa Expedition & Safaris Ltd at least two (2) working days before safari commencement, unless otherwise agreed in writing.
USD Cash Payments
USD cash payments are accepted only in Series 2009 or newer banknotes and must be in good condition. Older, damaged, excessively marked, torn, or defaced notes may be rejected where they are not acceptable to local banks or financial institutions.

CANCELLATION POLICY
All cancellations must be submitted in writing and shall become effective only upon written acknowledgement by Axis Africa Expedition & Safaris Ltd.
Standard Refund Schedule
The following refund schedule applies subject to any non-refundable supplier deposits, cancellation penalties, transaction costs, and other amounts already committed or paid on the client's behalf:
• 60 days or more before departure: Refund of amounts paid, less a USD 60 administration fee and applicable non-refundable costs
• 40–59 days before departure: Up to 75% refund
• 14–39 days before departure: Up to 45% refund
• 7–13 days before departure: Up to 25% refund
• Less than 7 days before departure or no-show: No refund
Important Cancellation Conditions
• Refunds apply only to funds actually received by Axis Africa Expedition & Safaris Ltd.
• Where a hotel, lodge, camp, airline, park, conservancy, or other supplier imposes cancellation conditions that are more restrictive than the Company's standard cancellation schedule, the supplier's applicable conditions shall take precedence in determining the refundable amount.
• Any non-refundable accommodation deposits, airline tickets, park or conservancy fees, government levies, visa fees, transaction charges, bank charges, exchange losses, payment processing fees, or other costs already incurred or committed on behalf of the client shall be deducted from any refund.
• Supporting evidence of applicable supplier charges will be provided where reasonably available.
• No refund shall be provided for unused services, voluntary itinerary changes, late arrival, early departure, missed transfers or activities, or services not utilized after the safari has commenced.
• Changes to travel dates, accommodation, routing, or other confirmed arrangements are subject to availability and may attract supplier amendment, cancellation, or rate-difference charges.
• Where a refund is due, it will be processed after applicable supplier cancellations and refunds have been determined. Refund processing times may therefore depend on the relevant supplier and banking/payment channels.

BOOKING & SUPPLIER CONDITIONS
Bookings made through Axis Africa Expedition & Safaris Ltd involve independent third-party suppliers, including accommodation providers, airlines, parks, conservancies, transport providers, and other service providers.
Bookings are therefore subject to the applicable terms, payment deadlines, cancellation conditions, and operational requirements of these suppliers.
Where a supplier's booking or cancellation conditions are more restrictive than the Company's standard terms, the supplier's applicable conditions shall prevail in relation to that service.
Additional Deposits
An initial deposit allows Axis Africa Expedition & Safaris Ltd to commence securing the requested services but does not override the individual payment requirements imposed by suppliers.
During periods of high demand, peak season, special events, or where required by a particular supplier, an additional deposit or full prepayment may be required to maintain or confirm a reservation.
Where this occurs, Axis Africa Expedition & Safaris Ltd reserves the right to request the additional amount within the supplier's stipulated deadline.
Failure to make the additional payment within the communicated deadline may result in the affected reservation being released, amended, repriced, or cancelled by the supplier, and Axis Africa Expedition & Safaris Ltd shall not be liable for loss of availability arising from such non-payment.

SUPPLIER & STATUTORY PRICE CHANGES
Certain costs, including but not limited to park fees, conservancy fees, government taxes and levies, concession fees, fuel surcharges, airline charges, insurance charges, statutory fees, and other supplier-imposed costs, are outside the control of Axis Africa Expedition & Safaris Ltd.
Where any such charge is introduced or increased after booking or quotation, Axis Africa Expedition & Safaris Ltd reserves the right to charge the applicable supplement necessary to cover the increase.
Any such adjustment will be communicated to the client as soon as reasonably practicable, together with supporting information or evidence where available.

CURRENCY FLUCTUATIONS
Quotations are based on supplier tariffs and applicable exchange rates at the time the quotation is prepared.
Where material exchange-rate fluctuations or supplier price revisions occur before travel and materially affect the cost of providing the confirmed services, Axis Africa Expedition & Safaris Ltd reserves the right to adjust the affected portion of the booking price, with prior notice to the client.

FORCE MAJEURE
Axis Africa Expedition & Safaris Ltd shall not be responsible for delays, changes, interruptions, inability to perform, or cancellations arising from circumstances beyond its reasonable control.
Such circumstances may include, but are not limited to, natural disasters, severe or adverse weather, floods, fires, disease outbreaks, epidemics or pandemics, government actions or restrictions, civil unrest, political instability, strikes, industrial action, border closures, airline cancellations or disruptions, road closures, security incidents, or other unforeseen events beyond the Company's reasonable control.
Where reasonably possible, Axis Africa Expedition & Safaris Ltd will endeavour to make alternative arrangements, reschedule affected services, or revise the itinerary.
Any additional costs resulting from such circumstances, including additional accommodation, transportation, flights, meals, park fees, or alternative arrangements, shall be borne by the client unless otherwise agreed in writing.
The occurrence of a force majeure event does not automatically entitle the client to a full refund. Any refund or credit shall be subject to amounts recoverable from the relevant suppliers and any non-refundable costs already incurred or committed on the client's behalf.

TRAVEL INSURANCE
Clients are strongly advised to obtain comprehensive travel insurance from the date of booking.
Insurance should, where appropriate, provide adequate cover for trip cancellation or interruption, medical expenses, emergency evacuation and repatriation, personal accident, baggage loss or damage, flight disruptions, and other unforeseen travel-related expenses.
Axis Africa Expedition & Safaris Ltd shall not be responsible for losses that could reasonably have been covered by appropriate travel insurance, subject to applicable law.

CLIENT CONDUCT & RESPONSIBILITIES
Clients are expected to behave responsibly and comply with all applicable laws, park and conservancy regulations, accommodation rules, safety instructions, and reasonable directions given by guides, drivers, suppliers, or representatives of Axis Africa Expedition & Safaris Ltd.
The Company reserves the right, where reasonably necessary for safety, legal compliance, or the protection of other guests, staff, wildlife, property, or suppliers, to discontinue or modify services for any client whose conduct is unlawful, abusive, threatening, dangerous, disruptive, or materially interferes with the safe operation of the safari.
Where services are terminated due to such conduct, the client shall be responsible for any resulting costs, and refunds shall be subject to costs already incurred and applicable supplier terms.
Clients are responsible for ensuring that they possess valid passports, visas, permits, vaccination or health documentation, travel insurance, and any other documentation required for their journey.

COMPLAINTS & SERVICE ISSUES
Should a client experience any problem or dissatisfaction during the safari, the matter should be reported as soon as reasonably possible to the driver-guide, tour consultant, supplier, or Axis Africa Expedition & Safaris Ltd so that the Company has a reasonable opportunity to investigate and, where possible, rectify the issue during the trip.
Where a complaint cannot be resolved during travel, the client should submit a detailed written complaint to Axis Africa Expedition & Safaris Ltd within fourteen (14) days after completion of the safari, together with any relevant supporting information.
Failure to report a problem when it occurs may limit the Company's ability to investigate or provide an appropriate remedy, particularly where the issue could reasonably have been addressed during the safari.

LIABILITY & THIRD-PARTY SERVICES
Axis Africa Expedition & Safaris Ltd acts as an organiser and intermediary in arranging certain services provided by independent third parties, including hotels, lodges, camps, airlines, parks, conservancies, activity providers, and other suppliers.
While the Company exercises reasonable care in selecting and coordinating suppliers, it does not directly control the day-to-day operations of independent third-party service providers.
Accordingly, to the extent permitted by applicable law, Axis Africa Expedition & Safaris Ltd shall not be liable for acts, omissions, delays, cancellations, service failures, accidents, loss, damage, or other circumstances arising solely from the actions or failures of independent third-party suppliers and outside the Company's reasonable control.
Nothing in these terms is intended to exclude or restrict any liability that cannot lawfully be excluded or restricted under applicable law.
Clients acknowledge that safari and adventure travel may involve inherent risks associated with wildlife, remote locations, road conditions, weather, terrain, and other natural or operational circumstances. Clients are expected to follow all reasonable safety instructions provided by guides, suppliers, park authorities, and Company representatives.

GOVERNING LAW & DISPUTE RESOLUTION
These terms and any booking made with Axis Africa Expedition & Safaris Ltd shall be governed by and interpreted in accordance with the laws of the Republic of Kenya, subject to any mandatory consumer protections or other rights that may apply under applicable law.
In the event of a dispute, both the client and Axis Africa Expedition & Safaris Ltd shall first make reasonable efforts to resolve the matter amicably and in good faith through written communication and negotiation.
Where a dispute cannot be resolved amicably, the parties may pursue mediation or another mutually agreed alternative dispute-resolution mechanism before commencing formal proceedings.
Where formal legal proceedings become necessary, they shall be submitted to the courts of competent jurisdiction in Kenya, subject to any mandatory legal rights or jurisdictional requirements that cannot lawfully be excluded.

ACCEPTANCE OF TERMS
By making any deposit, partial payment, or full payment toward a booking, the client confirms that they have read, understood, and accepted these Payment Terms, Cancellation Policy, Booking & Supplier Conditions, and the Company's General Terms and Conditions.
Where a booking is made on behalf of multiple travelers, the person making the booking is responsible for communicating the applicable booking terms and conditions to all travelers included in the reservation.
