General Terms and Conditions :

Please read the following booking conditions carefully and make sure you understand them before booking your holiday. By paying your non-refundable deposit, or by making full payment, you acknowledge that you have read and understand and agree to be bound by these Booking Conditions.

1. Bookings :

Bookings shall be confirmed in writing (E-mail , fax, or via post). Bookings shall be considered confirmed only when the booking is accompanied by a deposit valued at 30% of the tour price, whose receipt has been acknowledged by our bank. The remaining 70% must be paid 6 weeks before the tour begins. Please see the payment section below to see what types of currency we accept.

2. Cancellations & Refund :

All cancellations must be advised in writing, signed by the signatory of the booking form and sent to Gundua Africa adventures info@gunduaafrica.com Cancellations are effective on the day they are received by Gundua Africa adventures recorded delivery is strongly recommended. Since we incur costs in cancelling your travel arrangements, the following cancellation charges will be payable, depending upon the number of days prior to departure, Gundua Africa adventures receives your notice of cancellation.

Days prior to Departure Date % of Total Holiday Cost 180-91 days 20% of total holiday cost. 90-46 days 50% of total holiday cost. Within 45 days or no show 100% of total holiday cost.

3. Amendments :

Should the client amend their booking at any stage, either in the form of a date change, itinerary amendment or any change whatsoever, Gundua Africa Adventures reserves the right to charge an amendment fee per booking. One itinerary amendment is free, thereafter each change may be charged at 60$per booking, over and above the tour cost.

4. Refunds For Unused Travel Services :

No refund is available for cancellation after travel has commenced. If you make any alteration to any portion of your holiday while you are away, costs incurred by such alteration will be at your own expense. After the holiday has commenced, no refunds are available for any services/ground content provided in the tour price but not utilized by you for any reason.

5. Insurance :

5.1 - The client shall be responsible for arranging and effecting adequate insurance cover to ensure that he carries comprehensive travel and medical insurance cover in order to cover himself, his dependants and / or travelling companions for the duration of the booking for which he has reserved. This insurance cover should include cover in respect of, but not limited to, as a minimum, the following eventualities: any expenses associated with cancellation or curtailment of a safari booking reservation; emergency evacuation and medical expenses; personal injury, repatriation expenses; damage / theft / loss of personal baggage, money and goods.

5.2 Under no circumstances shall Gundua Africa Adventures ltd, its representatives, employees or members be responsible for any costs, losses incurred or suffered by a client, his dependants or travelling companions with regard to, but not limited to, the above eventualities. Clients will be charged directly for any emergency evacuation, repatriation and medical expenses by the relevant service providers and shall be obliged to settle such charges payable to the relevant service providers concerned.

6. Vaccinations & Health :

6.1- It is the client’s responsibility to be aware of malaria, yellow fever, Covid19 and other potential diseases when travelling to Africa. The client must take all necessary vaccinations and precautions, as are required in the prevention of these diseases, which are endemic to certain regions of Africa. The client shall therefore prior to embarking on the services for which is booked attend a medical practitioner or a travel clinic to obtain the necessary vaccinations, medication and advice. Gundua Africa Adventures does not accept any responsibility whatsoever for any client being refused entry to any country due to incorrect or incomplete health documentation or vaccinations.

6.2 - Clients should be medically fit, in good health and able to embark upon a trip. If the Client has any pre-existing medical condition or illness, they must declare the true nature of such condition at the time of booking and make arrangements for the provision of any drugs or other cause of treatment, which may be required during their trip. In some cases, the Client will be required to provide a medical statement from a medical practitioner to confirm that they are fit for a tour or trip. Gundua Africa Adventures and its representatives will treat all information in the strictest confidence.

Health Warnings: Malaria and Yellow Fever, Health Issues: ‘Own Medication Responsibilities, Insurances, Emergency Medical Evacuation Insurance, are all extensively detailed on this Gundua Africa adventures website.

7. Passports And Visas Requirements :

All travellers require a passport with at least six months validity beyond completion of travel. The client accepts full responsibility for obtaining all travel documentation, including but not limited to passport, entry visa and permits prior to commencement of travel, and is solely responsible for any consequences resulting from missing or defective documentation(s). Any information or advice given by Gundua Africa Adventures regarding visas, vaccinations, climate, what to pack, baggage, etc., is purely advisory and provided as a courtesy. Gundua Africa adventure is not responsible for any errors or omissions as to the information provided by third parties. It is the responsibility of the individual traveller to secure the proper documentation(s) prior to commencement of travel.

8. Force Majeure / Alterations To Itineraries :

8.1 - “Force Majeure “ means, in relation to the company, any circumstances beyond the control of the company (including and without limitation, acts of God, explosions, floods, tempests, fires, accidents, war or threat of war, sabotage, insurrection, civil disturbance or requisition, sickness, quarantine, government intervention, weather conditions or other outwards occurrences)

If the company is affected by force majeure it shall forthwith notify you of the nature and extent thereof.

8.2 - The company shall not be deemed to be in breach of these items and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any force majeure.

8.3 - If the company is affected by force majeure it shall be entitled to, and may at its sole and absolute discretion, vary or cancel any reservations or cancel any reservation or arrangement in relation to the visits. Payment of any refund by the company to you as a result of the non-performance of any company shall use its reasonable endeavours to reimburse you where possible. However, the company shall be entitled to deduct from any refund recoverable to the reasonable actual and potential costs to the company of the force majeure.

8.4 - Any extra costs and expenses occasioned as a result of an alteration to or cancellation of itineraries as provided for in clause 9.1 above shall be payable by the client on demand by Gundua Africa Adventures

8.5 - Gundua Africa Adventures may further in its sole discretion cancel or terminate a client’s booking for the services or any remaining part thereof in the event of any illness or the illegal or incompatible behaviour of the client, who shall, in those circumstances, not be entitled to any refund. Any extra costs occasioned by such cancellation or termination as provided for in this sub-clause 6.5 shall be payable by the client on demand.

9. Liability :

The Client hereby acknowledges confirms and records that he/she understands the risk inherent in adventure travel in African destinations and associated activities. The Client is accepted onto the tour and undertakes to do the tour, travel or activity at his/her own risk. The client agrees and concedes that the Company, its representatives and employees shall not be responsible for loss or damage to possessions, injury or illness to the client or loss of life or consequential damages which might occur from any cause whatsoever unless directly caused by the Company’s negligence.

10. Luggage Allowance :

Baggage is strictly limited to one large bag, weighing a maximum of 15 kg. Also allowed will be a smaller hand-luggage bag or camera bag per Client. These restrictions are essential because of the nature of the tour. Because overloaded vehicles are inherently dangerous and cause unnecessary transport problems, potentially endangering Clients and Company representatives, the Company insists that every Client adheres to these luggage restrictions.

11. Contracts :

Once payment in whole or in part has been made by the traveller for a booking, the traveller shall be deemed to have accepted the terms and conditions contained herein as applicable to the contract entered into between the Company and the traveller.

12. Accommodation :

Wherever possible, we book rooms with private baths throughout on basis of two people sharing the room . Single rooms or rooms with private baths cannot be guaranteed. Single rooms are scarce and cannot be guaranteed. Where it occurs, an appropriate refund will be made direct to the client's Hotels, lodges and camps where mentioned, are named as an indication of category and rooms may be reserved at similar hotels, lodges and camps.

13. Photographing :

It is prohibited to take pictures of Statehouse, airports, military fittings, police stations, government facilities, soldiers or police or any other person and any other things that are protected, we advise you to seek information from your driver guide before taking pictures

14. Gundua Africa Adventures Acting As Agent Only :

Gundua Africa Adventures acts only as an agent for the various independent suppliers that provide hotel accommodations, transportation, sightseeing, activities, or other services connected with its tours. Such services are subject to the terms and conditions of those suppliers. Gundua Africa Adventures and their respective employees, agents, representatives, and assigns accept no liability whatsoever for any injury, damage, loss, accident, delay, or any other incident which may be caused by negligence, defect, the default of any company or person in performing these services.

Responsibility is not accepted for losses, injury, damages or expenses of any kind due to sickness, weather, strikes, hostilities, wars, terrorist acts, acts of nature, local laws or other such causes. All services and accommodations are subject to the laws and regulations of the country in which they are provided. Viola Tours & Travel is not responsible for any baggage or personal effects of any individual participating in the tours/trips arranged by Viola Tours & Travel. Individual travellers are responsible for purchasing a travel insurance policy if desired, that will cover some of the expenses associated with the loss of luggage or personal effects.

15. Claims And Complaints :

In the unlikely event that the client has a complaint against the company, the Company must be informed immediately, in order that an opportunity is afforded to the company to investigate the situation and provide redress. If the client has any further complaints, these must be lodged in writing to the Company within 1 month of the tour end date. If these procedures are not followed, the Company will not start or continue any such investigation of said complaint.

Any legal proceedings arising out of or in connection with these standard terms and conditions, or any agreement entered into pursuant thereto, shall be instituted in the Arusha branch of the High Court of Tanzania, which shall have exclusive jurisdiction to hear and determine such legal proceedings. Generally, should any legal dispute arise it must be settled in Arusha – Tanzania where Viola Tours & Travel office base is located and this website is created, maintained and controlled in the United Republic of Tanzania and as such, the laws of the United Republic of Tanzania and the jurisdiction of the Tanzania Courts govern this user agreement and the use or inability to use this site.

16. The Company Authority :

Any decision made by the tour guide, acting as a Company representative, shall be deemed final on all matters. The company shall not be responsible or liable for any client who commits an illegal or unlawful act in any country visited, or the consequences of such an illegal act. The client may in such circumstances be excluded from the tour without a refund, at the sole discretion of the Company or Company representative. If the Company considers a client unsuitable for a tour (due to mental or physical illness or implied danger to any other Client or Company representative) it may at its sole discretion decline to carry the Client further. If a Client causes severe inconvenience or annoyance to other Clients, the Company may decline to carry the client further, without any refund whatsoever. This will only occur after extensive intervention by the tour guide or Company representative.

17. Company Responsibilities And Rights :

The information in any brochure and printed itineraries is given in good faith by the Company and is based on the latest information available to the Company. Printed itineraries serve as a guideline only. The company reserves the right to change the facilities or transport described in any publication without being liable for any compensation or refund.

18. Risk :

The company and its owner, director, management staff and employees shall not be held responsible for any injury or death to persons on tour, nor for loss or damage to personal property, however, may they be caused.
The company draws your attention to the fact that there are certain inherent risks present when on Safari, or when engaging in any strenuous physical activity. It is your sole responsibility to obtain appropriate medical advice as to medication, immunization, and whether or not you are fit enough to undertake the trip, prior to departure. The company shall not be liable for illness, injury or death sustained whilst visiting the properties owned and managed by the company.

19. Unavoidable Circumstances :

The company does not hold itself responsible nor can it be held responsible for any delays prior to departure or, during the course of any tour mentioned whether brought about by technical difficulties, strikes, weather conditions or any other circumstances whatsoever, whether foreseen or unforeseen. It is understood that any expenses relating to these unscheduled extensions or curtailments (eg. hotels, meals, airfares, telephone calls, etc) will be for the travellers' account. We make every effort to ensure that all arrangements and services connected with your tour will be carried out as specified in the most efficient and effective way possible. However, we do not have direct control over the provision of services by suppliers and, whilst they are in all cases selected with the utmost care, we do not accept liability for error and omissions of such suppliers.

20. Terms And Conditions :

These are the terms and conditions governing the relationship between the company and you, to the total exclusion of any other terms and conditions. No alterations to the terms and conditions may be made by any of the company’s employees, authorized representatives or agents, unless in writing by an authorized officer of the company. All decisions and matters subject to the company’s discretion shall be by an authorized officer of the company. The Company reserves the right to employ sub-contractors for all or part of the services.
