SAFARI BOOKING TERMS & CONDITIONS

1. Booking & Confirmation

All safari bookings are subject to availability and are only confirmed after Nyana Tours and Travel receives the required deposit or full payment as stated in the booking quotation.

A booking confirmation will be issued once the required payment has been received. A booking is considered confirmed only after written confirmation from Nyana Tours and Travel.

2. Payment Terms

The payment schedule will be communicated to the client at the time of booking and may vary depending on the safari, accommodation, permits, transport arrangements, and service providers involved.

Clients are responsible for making payments by the agreed deadlines. Failure to make payments on time may result in cancellation of the booking or loss of reserved services.

All bank charges, transfer fees, or other transaction costs associated with payments are the responsibility of the client unless otherwise agreed.

3. Safari Permits & Special Activities

Some activities, including gorilla trekking, chimpanzee tracking, and other regulated activities, require permits or advance reservations.

Once permits have been purchased or secured on behalf of the client, they may be subject to the cancellation and refund policies of the relevant authority. Nyana Tours and Travel will communicate applicable permit conditions to the client before purchase.

4. Cancellation by the Client

Cancellation requests must be submitted to Nyana Tours and Travel in writing.

Refunds, where applicable, will depend on the cancellation terms of accommodation providers, parks, airlines, transport providers, permit authorities, and other suppliers involved in the booking.

Certain services, including permits, promotional rates, deposits, and advance payments to suppliers, may be non-refundable.

Any applicable refund will be processed after deducting non-refundable supplier charges and administrative costs.

5. Cancellation or Changes by Nyana Tours and Travel

Nyana Tours and Travel reserves the right to modify, reschedule, or cancel a safari where circumstances beyond our reasonable control affect the operation of the trip.

Where possible, we will provide suitable alternatives or adjustments to the itinerary.

If a trip must be cancelled by Nyana Tours and Travel and no suitable alternative is accepted, any refund will be handled in accordance with the amounts recoverable from the relevant suppliers.

6. Changes to the Itinerary

Safari itineraries are planned in advance but may require adjustments because of weather, road conditions, wildlife movements, park regulations, accommodation availability, government requirements, flight schedules, or other circumstances beyond our control.

Nyana Tours and Travel reserves the right to make reasonable changes to the itinerary where necessary while making every effort to maintain the quality and purpose of the safari.

7. Accommodation

Accommodation is provided according to the category and properties stated in the client's confirmed itinerary.

Accommodation is subject to availability at the time of booking. Where the specified property becomes unavailable, Nyana Tours and Travel may provide an alternative of a similar standard where reasonably possible.

Any upgrade requested by the client may result in an additional charge.

8. Transportation

Transport is provided according to the vehicle type stated in the confirmed safari package.

Clients are expected to follow reasonable safety instructions provided by the driver/guide.

The company may replace a vehicle where necessary because of mechanical problems, road conditions, safety concerns, or other operational reasons.

9. Wildlife & Safari Activities

Wildlife sightings cannot be guaranteed. Animals move freely in their natural environment, and sightings depend on factors including season, weather, wildlife movements, and park conditions.

Nyana Tours and Travel will make reasonable efforts to provide the best possible safari experience but does not guarantee the sighting of any particular animal.

10. Client Responsibilities

Clients are responsible for:

* Providing accurate personal and passport information.
* Ensuring they have valid passports and appropriate visas.
* Obtaining recommended vaccinations and health documentation where required.
* Following park rules and regulations.
* Following instructions from guides, drivers, park rangers, and other authorized personnel.
* Taking care of personal belongings.
* Disclosing relevant dietary requirements or special requests before travel.
* Arriving at agreed departure points and times.

Clients may be responsible for additional costs resulting from inaccurate information, missed transfers, late arrival, or failure to comply with agreed travel arrangements.

11. Passports, Visas & Travel Documents

It is the client's responsibility to ensure that all travel documents are valid and that they meet the entry requirements of the countries they intend to visit.

Nyana Tours and Travel may provide general travel information and assistance but is not responsible for visa refusals, passport problems, immigration decisions, or failure to meet entry requirements.

12. Travel Insurance

Travel insurance is strongly recommended for all travelers.

Clients are responsible for obtaining appropriate insurance covering, where applicable, medical expenses, evacuation, cancellation, lost luggage, personal belongings, and other travel-related risks.

Nyana Tours and Travel is not responsible for losses that could reasonably have been covered by appropriate travel insurance.

13. Health & Fitness

Some safari activities, particularly gorilla trekking, chimpanzee tracking, hiking, and nature walks, may require a reasonable level of physical fitness.

Clients are responsible for assessing their ability to participate in activities and should inform Nyana Tours and Travel of any relevant limitations before booking.

14. Personal Belongings

Clients are responsible for their personal belongings, luggage, money, passports, cameras, electronics, and other valuables throughout the trip.

Nyana Tours and Travel will take reasonable care but cannot be held responsible for loss, theft, or damage to personal belongings unless caused by the company's proven negligence.

15. Children & Minors

Children must be accompanied by a responsible adult unless otherwise agreed in writing.

Age restrictions may apply to certain activities, parks, permits, accommodations, and transport services. Parents or guardians are responsible for ensuring that children comply with applicable rules.

16. Special Requests

Special requests such as dietary requirements, room preferences, celebrations, accessibility needs, private vehicles, or specific accommodation should be communicated at the time of booking.

Requests are subject to availability and cannot be guaranteed unless confirmed in writing.

17. Force Majeure

Nyana Tours and Travel shall not be liable for failure or delay in providing services caused by circumstances beyond its reasonable control, including but not limited to natural disasters, extreme weather, epidemics, government restrictions, political unrest, civil disturbances, road closures, strikes, accidents, changes in park regulations, border closures, or other unforeseen events.

18. Prices

Safari prices are based on the costs available at the time of quotation.

Prices may change before confirmation due to changes in accommodation rates, park fees, permits, fuel prices, taxes, exchange rates, transportation costs, or supplier charges.

Once a safari has been fully confirmed, any unavoidable additional supplier charges will be communicated to the client before they are incurred where reasonably possible.

19. Photography & Marketing

Nyana Tours and Travel may take photographs or videos during trips for marketing purposes.

Clients who do not wish to appear in promotional materials should notify Nyana Tours and Travel before or during the trip.

20. Complaints

Any complaint arising during a safari should be reported to the Nyana Tours and Travel representative, guide, or driver as soon as possible so that reasonable efforts can be made to resolve the matter during the trip.

Complaints that cannot be resolved during the trip should be submitted in writing after completion of the safari.

21. Third-Party Service Providers

Nyana Tours and Travel may work with independent accommodation providers, airlines, transport companies, park authorities, guides, activity providers, and other suppliers.

Their services are subject to their respective terms, conditions, operational requirements, and cancellation policies.

22. Acceptance of Terms

By making a booking or making payment towards a safari, the client confirms that they have read, understood, and accepted these Terms & Conditions.

Nyana Tours and Travel reserves the right to update these Terms & Conditions from time to time. The terms applicable to a confirmed booking will be those communicated to the client at the time of confirmation, subject to necessary changes imposed by suppliers or authorities.
