Wajefya Expeditions – Terms and Conditions

Welcome to Wajefya Expeditions. By booking or using our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before making any reservation or inquiry.

1. Booking and Payment Terms

- All bookings are subject to availability and written confirmation by Wajefya Expeditions.
- To secure a booking, a (non‑refundable deposit of 20%) of the total tour cost is required at the time of booking, unless otherwise stated in writing.
- The (remaining balance) is due 30 days before the tour start date or on arrival, as specified in your booking confirmation.
- Payments may be made by bank transfer, credit/debit card, mobile money, or any other payment method approved by Wajefya Expeditions.
- All bank and transfer charges are the responsibility of the client unless agreed otherwise in writing.
- (Late payment) may result in automatic cancellation of the booking, with loss of the non‑refundable deposit and any other non‑recoverable costs already incurred on your behalf.

2. Cancellation Policy

All cancellations must be submitted in writing (email is sufficient) and are effective from the date received by Wajefya Expeditions.
- More than 60 days before departure:
Refund of all payments (minus the non‑refundable deposit) and any non‑recoverable third‑party costs.
- 30 to 59 days before departure:
Refund of 50% of the total tour cost (including the deposit), less any non‑recoverable third‑party costs.
- Less than 30 days before departure or no‑show:
(No refund) will be made.

Wajefya Expeditions reserves the right to cancel a tour due to insufficient bookings, safety concerns, force majeure, or other unforeseen circumstances. In such cases, clients will be offered:

1. An alternative tour of comparable value (subject to availability), or
2. A (full refund) of all payments made to Wajefya Expeditions for that tour, which shall constitute full and final settlement.

Wajefya Expeditions is not responsible for any additional costs incurred by the client (e.g., international flights, visas, vaccinations, travel insurance, or other personal expenses).

3. Travel Documents and Insurance

- Clients are solely responsible for obtaining and carrying a (valid passport), any require ( visas), and all recommended or required (vaccinations and health certificates) for the destinations visited.
- Wajefya Expeditions does not accept liability for any consequences, damages, or losses arising from a client’s failure to obtain proper travel documents or to comply with immigration, health, or customs regulations.
- Comprehensive (travel insurance) is (strongly recommended). Your policy should cover, at a minimum:
- Medical expenses and emergency evacuation
- Trip cancellation and curtailment
- Personal accident and liability
- Loss or damage to baggage and personal effects

Clients are advised to carry proof of insurance during the tour.

4. Itineraries and Changes

- Every effort will be made to operate the tour as per the ( confirmed itinerary ). However, changes may be necessary due to weather conditions, road conditions, flight delays or cancellations, park regulations, government actions, safety considerations, or other circumstances beyond our reasonable control.
- Wajefya Expeditions reserves the right to:
- Modify routes, accommodation, transportation, or activities,
- Substitute services of similar or higher standard when necessary.

Such changes will not normally entitle the client to any refund or compensation, provided the overall tour value is maintained.

- Client‑requested changes (such as date changes, itinerary adjustments, or accommodation upgrades) are subject to availability and may incur additional charges and/or administrative fees. Any such changes must be agreed in writing.

5. Health, Fitness, and Safety

- It is the client’s responsibility to ensure they are physically and medically fit for the activities included in the chosen itinerary (e.g., game drives, walking safaris, high‑altitude trekking, cultural visits).
- Clients must inform Wajefya Expeditions, at the time of booking, of any existing medical conditions, disabilities, allergies, dietary requirements, or special needs that may affect participation in the tour.
- Wajefya Expeditions and its guides reserve the right to refuse participation in certain activities if, in their reasonable opinion, a client is not fit, may pose a danger to themselves or others, or may compromise the experience for the group.
- While Wajefya Expeditions takes reasonable care to ensure your safety, travel in remote areas, wildlife encounters, and outdoor activities involve (inherent risks).
- Wajefya Expeditions is (not liable) for injuries, illnesses, or medical conditions occurring during or after the tour, except where caused directly by our proven negligence.

6. Shared / Group Safari Arrangements
For certain departures, Wajefya Expeditions may operate shared or group safaris in collaboration with other licensed safari operators in Tanzania to guarantee confirmed departures.

- Clients may travel in a safari vehicle branded with (Wajefya Expeditions ) or another partner operator, depending on final group allocation.
- Regardless of vehicle branding or guiding personnel, the itinerary, accommodations, inclusions, and agreed service standards, remain as confirmed in your booking.
- Group composition (nationalities, ages, backgrounds) may vary and cannot be guaranteed.

7. Responsibility and Liability

- Wajefya Expeditions acts as an organizer and intermediary between clients and third‑party service providers, including but not limited to: airlines, hotels, lodges, camps, vehicle operators, activity providers, and other independent contractors.
- While we exercise due care in selecting reputable suppliers, we do not own or control these third parties and therefore are not responsible for:
- Any accident, injury, illness, death, loss, damage, delay, or inconvenience caused by any act or omission of a third‑party provider;
- Any failure or delay in performance resulting from third‑party actions or events beyond our control.

- Wajefya Expeditions will not be liable for:
- Loss or damage to personal property,
- Consequential or indirect losses,
- Any errors, omissions, or inaccuracies in brochures, digital content, or other promotional materials, although we strive for accuracy.

Where Wajefya Expeditions is found liable by a competent court, such liability shall, to the maximum extent permitted by law, be limited to the amount actually paid by the client to Wajefya Expeditions for the specific tour in question.

8. Force Majeure

Wajefya Expeditions shall not be liable for any failure to perform, or delay in performance of, any of its obligations under these Terms and Conditions where such failure or delay is due to (force majeure), including but not limited to:

- Natural disasters (e.g., floods, earthquakes, drought, storms),
- War, terrorism, civil unrest, strikes, or riots,
- Epidemics, pandemics, or public health emergencies,
- Government actions, travel restrictions, or park closures,
- Any other event beyond the reasonable control of Wajefya Expeditions.

In such circumstances, we will use reasonable efforts to offer alternative arrangements or to recover and refund any part of the tour cost that is recoverable from suppliers, after deduction of non‑recoverable costs and reasonable administrative expenses.

9. Complaints and Dispute Resolution

- Any complaint or concern should be reported immediately to your guide or a Wajefya Expeditions representative so that we have a fair opportunity to resolve the issue on the spot.
- If the matter is not resolved to your satisfaction during the tour, a written complaint should be submitted to Wajefya Expeditions within (14 days) of the tour end date, providing full details and any supporting evidence.
- Wajefya Expeditions will review and respond to your complaint in a timely and fair manner.

Any unresolved dispute arising out of or in connection with these Terms and Conditions or your tour shall be governed by the laws of the (United Republic of Tanzania) and submitted to the exclusive jurisdiction of the competent courts of Tanzania.

10. Photographs, Videos, and Marketing
- During the tour, Wajefya Expeditions staff or representatives may take photographs or videos in which you may appear.
- Unless you expressly request otherwise in writing before or during the tour, you grant Wajefya Expeditions permission to use such images for promotional and marketing purposes (including on our website, social media, and printed materials), without compensation.
- Clients who do not wish to be photographed or filmed must inform their guide and/or our office in writing.

11. Privacy and Data Protection
- Wajefya Expeditions collects personal information (such as names, contact details, passport information, and special requirements) solely for the purpose of processing your booking and delivering travel services.
- We will not sell or share your personal data with unaffiliated third parties for marketing purposes. Information may be shared with trusted partners and service providers (e.g., hotels, airlines, parks) strictly as required to operate your tour.
- By booking with us, you consent to the use of your personal data in accordance with this clause and applicable data protection laws.

12. Governing Law

These Terms and Conditions are governed by the laws of the United Republic of Tanzania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tanzania.
